In this policy, “personal information” means any information relating to an identified or identifiable individual who engages with our Services or otherwise becomes a customer of Infiniaire.

PERSONAL INFORMATION

At various times, you may decide to provide us with your personal information. Infiniaire collects personal information in several ways when you place an order, subscribe to our newsletter and register to our services offered. You should know that we receive and may store all personal information (whether written or oral) that you provide to us. This includes personal information provided to us through any means, including, without limitation, through our Site, via e-mail, over the telephone, and through a social media service (for example Instagram, Facebook, Twitter, Pinterest). You can choose not to provide certain information, but then you might not be able to purchase products or take advantage of many of our promotions, features or Services. If an order is placed with us, we need to hold your personal information including your name, email address, contact numbers, shipping and billing address so we can process and fulfill your order. In addition, we may collect information about your purchases, billing address, shipping address, gender, occupation, birthday, marital status, anniversary, interests, and credit card information.
You may also choose to provide us names or other contact information for a friend to take advantage of a referral, fiancé, or other program or to send them product information or gifts. Subject to restrictions imposed under applicable laws and unless otherwise specified when you provide us the information, the information we collect about you and your friend may be stored and used in the ways described in this Privacy Policy. We may also obtain additional information as a result of authentication or identity checks. These details allow us to process your order.

DURATION OF DATA STORAGE : We will process your data as long as necessary to provide our products and services, and beyond such time to the extent legally permitted and based on our legal obligations (e.g. in relation to invoice retention) or legitimate interests (e.g. in retaining data for the purposes of responding to possible disputes or complaints or for possible reactivation of subscriptions). As a result, not all your data will be deleted after the end of the provision of the services, but we limit our processing to what is necessary.


DATA PROTECTION & TRANSFER

We use Secure Socket Layering ( SSL), the latest industry-standard encryption technology that ensures safe internet transmission of your personal information. The personal data collected by us may be transferred to any third parties to whom Infiniaire subcontracts all or part of this processing. This may for instance include IT service providers, hosting providers, financial institutions, public authorities and any other relevant roles. Note that we will never sell your personal information to a third party.

In the event of transfer of personal data to a country outside of the European Economic Area, Infiniaire systematically ensures the application of an adequate level of protection of such personal data by means approved by applicable data protection legislation. In addition, we will take reasonable steps to ensure that third party business partners’ to whom we transfer any data will provide sufficient protection of that personal information.

Infiniaire may also, pursuant to a valid legal process (such as a search warrant, subpoena, or court order), allow access to information in our possession, including personal data, in order to comply with such process and to protect our rights and property. If warranted, we may also allow access to this information in special emergencies where physical safety is at risk. We reserve the right to disclose any personal data or other information obtained from or about you, to third parties in connection with a merger, acquisition, bankruptcy or sale of all or substantially all of our assets, to the extent that this is necessary for the process.

SERVICE PROVIDERS

We use trusted third- party service providers to perform certain services on our behalf, including: shipping,  payment processing, data storage/management, web hosting, web analytics, shipping, mailing, emailing and marketing; as well as various customer, tech and operational support.
These service providers only receive personal information if such information is needed to perform their function(s), and they are not authorized to use any personal information for any other purpose(s) other than the purpose(s) set forth by Infiniaire – Infiniaire.

We may share your personal information with our affiliated entities, e.g., any corporate subsidiaries or affiliates.

If you choose to participate in a special event (for example, a promotion, contest, or sweepstakes), Infiniaire may share your information with those organizations participating in the applicable event.

(4) to enforce any agreement we have with you.

Your information may also be disclosed as part of any merger, sale of company assets or acquisition, as well as in the event of an insolvency, bankruptcy or receivership (or in due diligence leading up to any acquisition), in which case information would be transferred as one of the business assets of the Company.

We may, and we may authorise third parties to, create aggregate records from personal information by excluding information that makes the information identifiable. We may use and disclose, and authorise third parties to use and disclose, aggregate non-personal information at our discretion.

 

CHILDREN UNDER 13
Infiniaire does not knowingly collect personal information from children under the age of 13. If we learn that we have collected personal information from a child under the age of 13, we will delete that data from our systems.

Our Site may provide links to third-party websites which are outside our control and not covered by this Privacy Policy. We encourage you to review the privacy policies posted on these (and all) websites.

MARKETING CHOICE/OPT-OUT

Where permitted by applicable law, we want to communicate with you on our marketing initiatives, but only if you want to continue to hear from us.
To opt out of receiving email promotions that we send you:
(1) select “unsubscribe” on our subscription status page and enter the requested information or follow the unsubscribe instructions in any of our promotional emails; or
(2) write to Infiniaire, Postbus 66, Gent Centrum, 9000 Gent, Belgium (a “postal request”). To opt out of telephone promotions, you can tell us when we call you or you can send us a postal request. To opt out of postal mail promotions, please send us a postal request.

Opting out of communication with us does not affect our communications with you via telephone or email related to your orders with us or other transactional emails.

Where required by law, we obtain your prior opt-in consent at the time of data collection for the processing of
(i) personal information for marketing purposes and

Access right and data portability: you have the right to access your personal information processed by us, as well as the portability of data you have provided to us to the extent applicable.

Data accuracy: right of rectification and right to erasure. At all times, you have the possibility to request the rectification or erasure of your personal data, provided that the applicable legal requirements are met. The right to erasure is nevertheless subject to various exceptions, notably as regards personal data whose processing is necessary to support litigation or for compliance with statutory retention requirements. In such a case, however, we limit our processing to the extent possible, even without your request.

Limits to processing: right to restriction, right to object & consent withdrawal. You have the right, if applicable legal provisions are met, to object to the processing of personal data based on our legitimate interests and to otherwise obtain the restriction of certain forms of processing in specific circumstances. In particular, in relation to the processing of personal data for direct marketing purposes, you have the right to object at any time thereto. Where any processing is based on consent, you have the right to withdraw such consent at any time (without affecting the lawfulness of processing prior to the consent withdrawal). We will in each case examine your request an check whether you meet the requirements for the processing to be stopped.

Right to lodge a complaint with the supervisory authorities: you have the right to lodge a complaint with the data protection supervisory authority, notably (depending on your place of residence) the Belgian Data Protection Authority (https://www.privacycommission.be/en/contact-us).
